This Privacy Policy is in compliance with the Federal Decree Law No. 45 of 2021 Regarding the Protection of Personal Data (“Data Protection Law”) and applicable law/regulation which provides framework to ensure confidential and protection of information and privacy of personal data.

Data means an organized or unorganized set of information, facts, concepts, instructions, observations or measurements in the form of numbers, letters, words, symbols, pictures, videos, signals, audio, maps or otherwise, which is interpreted, exchanged or processed by individuals or computers. Data includes information wherever used herein.

Personal Data means any data relating to an identified natural person, or a natural person who can be identified, directly or indirectly, through the linking of data, by reference to an identifier such as his name, voice, picture, identification number, electronic identifier, geographical location, or one or more physical, physiological, cultural or social characteristics. Personal Data includes Sensitive Personal Data and Biometric Data.

Sensitive Personal Data means any information that directly or indirectly reveals a person's race, ethnicity, political or philosophical views, religious beliefs, criminal record, biometric data, or any data related to such person's health such as his physical, psychological, mental, corporal, genetic or sexual state, including any information related to such person's provision with healthcare services that reveal his health condition.

Biometric Data means any Personal Data resulting from specific technical Processing relating to the physical, physiological or behavioral characteristics of the Data Subject, which allow the identification or confirm the unique identification of the Data Subject, such as facial image or dactyloscopic data.

This Privacy Policy sets out the principles governing our use of your Personal Information (as defined below). The terms of this Policy will apply to the User as soon as you first use our Website. Should you wish to not continue to be bound by the terms of this Policy, please stop using our Website now.


Information we collect

All information voluntarily provided by the User at the time of registration on the Website that includes the User’s photos, personal contact details, personal information etc. shall be construed as “Personal Information”. The User gives his consent to store, access, rectify and erase his Personal Information from our Website inclusive of Data, Personal Data, Sensitive Personal Data and Biometric Data.

Our team will take appropriate actions as necessary, which may include removing the offending content, restricting user access, or reporting the incident to law enforcement authorities if necessary. Please note that we are not obligated to share the actions taken towards the violation.

This is information we receive about you from third parties that we work closely with to provide, promote, and improve our services. These third parties include business partners, vendors who assist in technical and payment services, advertising networks, analytics providers, and search information providers or information received if you sign-up from other Websites such as Google, Facebook or others.
Information we receive from other users:
Content posted about you by other users on our Website such as photos, reviews, or comments. We also may collect from other users or professionals details about your engagement with them in a certain project, such as the accuracy, response time or quality of the works performed. We do not control information or content that others have copied out of our Website.

We only share your personal data as necessary for any third party to provide the services as requested or as needed on our behalf. We reserve the right to use, disclose and transfer non-personal data to our partners, advertisers and other third parties at our discretion.
Other users, visitors or professionals
Other users on our Website are able to review, comment, like and save your uploaded, posted or created content on the Website, they also can message/contact you or follow your profile in a manner that is in line with our Terms and Privacy Policy. This is subject to your profile and privacy settings, as you can either enable or disable the public display of your content or limit the ability of other users to contact or follow your profile. Other users will receive notifications if you review, like, message or follow their profile. Website un-registered visitors will be able to view certain content on the Website but will not be able to interact with registered users.

We may share information from or about you with (a) joint ventures or other companies in the Manzzil group, or (b) a potential or actual acquirer, investor, successor, or assignee as part of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in bankruptcy or similar proceedings). In these cases, their use will be subject to this Privacy Policy.
Compliance with legal, regulatory and law enforcement requests:
In certain situations, we may be required to disclose personal information in response to lawful requests by public authorities or law enforcement requirements. We reserve the right to disclose your personal information as required by law and when we believe that disclosure is necessary to protect our rights, reputation, property or that of our users, visitors, affiliates or the public or to comply with a judicial proceeding, court order, or similar legal process served on us or our Website, or to enforce our agreements with you. We will take reasonable steps to ensure that we only collect that personal information that is relevant for the purposes for which it is to be used. Furthermore, we will not process your personal information in a way that is incompatible with these purposes.


Storage

Data we collect may be stored outside the Middle East. You agree to transfer, storage and processing of data, authorize personnel to access data and send relevant information when new listings/products are posted on the Website.
Cross-Border Transfer And Sharing Of Personal Data For Processing Purposes In Case There Is An Adequate Level Of Protection:A transfer of Personal Data outside the State may take place in the following cases approved by the Office:

  1. The state or territory to which Personal Data is transferred has Personal Data protection legislation in place, including the main provisions, measures, controls, requirements and rules in relation to the protection of confidentiality and privacy of the Personal Data relating to the Data Subject and his ability to exercise his rights, and provisions relating to the imposition of appropriate measures against the Controller or the Processor through a regulatory or judicial entity.
  2. The State’s accession to bilateral or multilateral agreements in respect of Personal Data protection with states to which Personal Data is transferred.

Cross-Border Transfer And Sharing Of Personal Data For Processing Purposes In The Absence Of An Adequate Level Of Protection:

  1. in states where no data protection law exists, Establishments operating in the State and in such states may transfer data under a contract or agreement binding the Establishment in such states to the provisions, measures, controls and conditions stated herein and containing provisions relating to the imposition of appropriate measures against the Controller or the Processor through a supervisory or judicial entity in such state which is specified in the contract.
  2. the express consent of the Data Subject to the Processing of Personal Data relating to him outside the State in such a manner that does not conflict with the public and security interest of the State.
  3. the transfer is necessary for performing obligations and establishing rights before judicial entities or exercising or defending them.
  4. the transfer is necessary for the entry into, or the performance of a contract between the Controller and the Data Subject, or between the Controller and a third party for the interests of the Data Subject.
  5. the transfer is necessary for the performance of an act relating to international judicial cooperation.
  6. the transfer is necessary for the protection of public interest.

Security

Once a User is registered with us, their account with us will be password protected for security and privacy. We endeavor to take reasonable steps to preserve the integrity and security of User’s Personal Information against unauthorized access, disclosure, reproduction or amendment. However, in the event of an unauthorized disclosure, we shall not be responsible or liable for any damages (moral or financial) caused due to such disclosure. In using the Website, the User accepts the inherent security implications of data transmission over the internet, and also agrees that the User will not hold us responsible for any breach of security.


Non-Personal Information

We may also collect certain non-personal information from the User on their visit to the Website such as information about User’s operating system, browser type, the URL of the web sites visited, their internet service provider and IP Address. This information is used to improve the Website content and performance. We may in the future also share such non-personal information with third party service providers to measure the overall effectiveness of our online advertising, content, programming and for other bonafide purpose, as we may desire. Processing Of Personal Data Without Consent Of The Data Subject

The Processing of Personal Data without consent of the Data Subject is prohibited. However, such prohibition is excluded and the Processing is lawful in the following situations:

  1. Where the Processing is necessary for the reasons of public interest.
  2. Where the Processing is related to Personal Data which is made available by Data Subject.
  3. Where the Processing is necessary to initiate or defend in any procedures relating to claim of rights and legal actions or is in relation to judicial or security procedures.
  4. Where the Processing is necessary for the purposes of occupational or preventive medicine to assess the working capacity of an employee, medical diagnosis, the provision of health or social care or the treatment or the management of health or social care systems and services, in accordance with legislation in force in the State.
  5. Where the Processing is necessary for the protection of public health, such as the protection from infectious diseases and pandemics, or for ensuring the safety and quality of healthcare, medicines, drugs and medical appliances, in accordance with legislation in force in the State.
  6. Where the Processing is necessary for archiving purposes or for scientific, historical or statistical studies in accordance with legislation in force in the State.
  7. Where the Processing is necessary for the protection of interests of the Data Subject.
  8. Where the Processing is required for the Controller or Processor to perform its obligations and establish its rights prescribed by law in the area of recruitment or social security or the laws relating to social protection, to the extent permitted by such laws.
  9. Where the Processing is necessary for the performance of a contract to which the Data Subject is a party or for taking any actions upon request of the Data Subject for the purpose of concluding, amending or terminating a contract.
  10. Where the Processing is necessary for the compliance with obligations prescribed under other laws of the State to which the Controller is subject.
  11. Any other situations specified by the Executive Regulations of this Decree-Law Federal Decree Law No. 45 of 2021.

Cookies

Similar to other commercial web sites, the Website utilizes standard technology called “Cookies” and web server logs to collect information about how the Website is used. This information is collected on an aggregate basis. None of this information can be associated with the User of our Website.


Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of United Arab Emirates.


Review of the Privacy Policy

We may review and update this Privacy Policy on a periodical basis. If any material changes are made, we will notify you.


Personal Data Protection Controls

The Processing of Personal Data shall take place in accordance with the following rules:

  1. the Processing must be fair, transparent and lawful.
  2. the Personal Data must have been collected for a clear specific purpose, and shall not be processed at a later stage in such a manner that is contrary to such purpose. However, Data may be processed if the purpose thereof is similar or close to the purpose for which the Data was collected.
  3. the Personal Data shall be adequate and restricted to what is necessary for the purpose for which the Processing is performed.
  4. the Personal Data must be correct and accurate and subject to update, where relevant.
  5. measures or actions to ensure the erasure or rectification of incorrect Personal Data must be in place.
  6. the Personal Data must be safely stored and protected from any Breach or unlawful or unauthorized Processing by putting in place and implementing appropriate technical and organizational measures and actions in pursuance of laws and legislation in force in this regard.
  7. the Personal Data must not be stored after the end of the purpose of their Processing, and may be maintained in case the identity of the Data Subject is concealed using “Anonymization” function.
  8. any other controls specified by the Executive Regulations of this Decree-Law Federal Decree Law No. 45 of 2021.

Third Party Sites

The User’s browsing and interaction on any third party Website including those that have a link on the Website are subject to such third party’s rules and policies. We shall not be held liable for any unauthorized access of the User’s Personal Information through the use of such third party Website/s.


Severability

Each of the provisions contained in this Privacy Policy shall be severable, and the unenforceability of one shall not affect the enforceability of any others or of the remainder of this Privacy Policy.


No Waiver

No failure or delay in enforcing any right or remedy in this Privacy Policy shall be construed as a waiver of any future exercise of such right or remedy.


Data Retention

We retain personal data only for as long as necessary to provide services you have requested for a variety of legitimate legal or business purposes. These retention periods might include:

  • those mandated by law, contract or similar obligations applicable to our business operations;
  • for preserving, resolving, defending or enforcing our legal/contractual rights; or
  • needed to maintain adequate and accurate business and financial records.

When you make changes to your content such as updates, deletions, revisions, or modifications, we may maintain copies of this information for our business records.
In the event your account is deactivated, your previously uploaded, created, posted and other content may still be available on our Website in line with the applicable law and Manzzil Terms. We also will retain de-identified information after your account is deleted.
Information you have shared with others will remain visible after your account has been deactivated or deleted and after the information has been deleted from your own profile or account.


Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Website and Services.


Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use the Service will cease immediately.


Notice

Any notice given pursuant to these Terms may be served personally or by email to the last known email address of the addressee. It is the responsibility of Users to promptly update us of any change of address or email address. Such notice shall be deemed to have been duly served upon and received by the addressee, when sent by email 24 hours after the email has been sent.
